AN ORDINANCE TO AMEND ORDINANCE 2011-06 PROHIBITING "PANHANDLING" IN THE CORPORATION LIMITS OF THE VILLAGE OF GAMBIER, OHIO;

WHEREAS, persons should be able to move freely upon the streets and sidewalks of the Village without undue interference from or exposure to intimidation or harassment by panhandlers; and

WHEREAS, aggressive panhandling of persons in the Village has become a concern to the Council of the Village of Gambier, Ohio;

WHEREAS, panhandling within the Corporation limits of the Village of Gambier is prohibited to ensure protection of pedestrian traffic and the free access and enjoyment of public places;

NOW, THEREFORE, BE IT ORDAINED: by the Council ofthe Village of Gambier, Ohio:

SECTION 1:

DEFINITIONS: for purposes of this Ordinance, "panhandling" means any solicitation made in person requesting an immediate donation of money for personal use. The purchase of an item for an amount far exceeding its value, under circumstances where a reasonable person would understand that the purchase is, in substance, a donation shall be considered a donation. "Panhandling" does include passively standing or sitting with a sign or other non-verbal indication that one is seeking personal donations, without addressing any solicitation to any specific person other than in response to an inquiry by that person.

SECTION 2:

PENALTIES: Any person in violation of the Village of Gambier ordinance prohibiting "panhandling" in the Corporation Limits of the Village of Gambier, Ohio shall constitute a minor misdemeanor and upon conviction thereof shall be fined an amount no more than $150.00.

This Ordinance shall be in effect and be in force from and after the earliest period allowed by law.

AN ORDINANCE PROHIBITING OWNERSHIP OF EXOTIC ANIMALS IN THE CORPORATION LIMITS OF GAMBIER, OHIO

WHEREAS, The Village of Gambier Council has determined that it is necessary to prohibit the ownership of exotic animals within the corporation limits of the Village of Gambier, Ohio,

BE IT ORDAINED THAT:

SECTION 1:

No person shall own, keep, possess, transport, or harbor within the Village Corporation limit an exotic animal of any kind, including but, not limited to any snake, reptile or lizard that is physically capable of causing serious injury to a person by bite, poison, constriction or other means; any lion, tiger, cougar, jaguar, panther, mountain lion, lynx, ocelot, leopard, or other non-domesticated feline; any wolf, coyote, jackal, fox, wild dog or hybrid; any bear or bison; or any non-human primate.

SECTION 2:

An exemption to the rule shall be made for the animals used in the research labs at Kenyon College, for research purposes only. The Village of Gambier shall require Kenyon College to provide a list of animals they use in the labs for research purposes at the beginning of every school year.

SECTION 3:

Any violation of the Village of Gambier ordinance prohibiting ownership of an exotic animal shall constitute a 3rd Degree misdemeanor. In addition to and not in lieu of any jail sentence or fine it may impose, a court may require a defendant convicted under this ordinance to forfeit any rights of the defendant in any exotic animal kept in violation thereof and to repay reasonable costs incurred by any person, municipality, county, or state agency in caring for the animal prior to judgment. When the court orders the defendant's rights in the exotic animal to be forfeited, the court may further order that those rights be given over to an appropriate person or agency demonstrating a willingness to accept and care for the animal or to the county or an appropriate animal care agency for further disposition in accordance with accepted practices for humane treatment of animals.

This Ordinance shall take effect and be in force from and after the earliest period by law.
