AN ORDINANCE TO AMEND ORDINANCE 2002-04, TO REGULATE PARKING WITHIN THE VILLAGE OF GAMBIER, OHIO AND PROVIDE PENALTY THEREFORE

WHEREAS, it is necessary to update the Village of Gambier's Parking Ordinance.

NOW, THEREFORE, BE IT ORDAINED: by the Council of the Village of Gambier. Ohio.

SECTION 6:

At the appropriate place within Ordinance 2002-04 the following shall read:

E. No person who is not handicapped or operating a motor vehicle to transport a handicapped person shall stop, stand or park any motor vehicle in parking spaces marked for handicapped use only. The handicapped spaces are marked by a handicapped sign in front of the parking space and painted blue parking lines. The handicapped parking spaces in the Village of Gambier are as follows:

1. The first parking space South of the loading zoning in front of the Village Market on Gaskin Ave.
2. The first parking space North of Scott Lane on Gaskin Avenue in front of the Kenyon Bookstore.
3. The first parking space South of the circle driveway of McBride Residence on Gaskin Avenue.
4. The first parking space East of Acland Street in front of the Epworth Church on Wiggin Street.

SECTION 6 REPEALER:

Simultaneously with the passage of the Ordinance, this Ordinance shall amend or repeal any and all Ordinances or sections of Ordinances that shall conflict with the modifications as above stated.

This Ordinance shall take effect and be in force from and after the earliest period allowed by law.

Ordinance 2008-01


AN ORDINANCE TO AMEND SECTION 15.5 C, REVIEW OF APPLICATIONS, OF ORDINANCE 1999-03 WHEREAS, the Council of the Village of Gambier has determined that it is necessary to revise Ordinance 1999-03. Section 15.5 C. upon recommendation of the Village Mayor, now therefore;

BE IT ORDAINED THAT,

SECTION 15.5 C At the appropriate place within Ordinance 1999-03 the following shall be changed to read:

C. At the conclusion of the hearing or meeting upon the application, it may take immediate action on the application, or it may delay action for up to thirty-one (31) days. In the event immediate action is taken, it shall verbally state its findings of facts and its decision. In the event action is taken at a later date, it shall reduce its findings of fact and its decision to writing. In all cases. its findings of fact and decision shall be announced in a public meeting, and shall be accurately reflected in the minutes of the meeting.

SECTION 15.5 C REPEALER: Simultaneously with the passage of the Ordinance. this Ordinance shall amend or repeal any and all Ordinances or sections of Ordinances that shall conflict with the modifications as above stated.

EFFECTIVE DATE: This Ordinance shall take effect and be in force from and after its passage and approval by the Mayor, or at the earliest period allowable by law.

Ordinance 2008-02


A ORDINANCE TO AMEND SECTIONS 2,3,4,5,6,7,AND 8, ADOPTING A FORMAL LIFT STATION POLICY, OF ORDINANCE 2004-13

Whereas, a number of private wastewater lift stations currently exist within the Village of Gambler. Ohio; and,

Whereas, additional private wastewater lift stations may be required from time to time in the future; and,

Whereas, additional private wastewater lift stations may be required from time to time in the future; and,

Whereas, the Village is desirous of adopting a formal policy with respect to the installation and maintenance of private wastewater lift stations.

Now, therefore be it ordained by the Council of the Village of Gambier. Ohio, as follows:

l. Purpose. The purpose of this Ordinance is to adopt a formal policy for the installation and maintenance of private wastewater lift stations within the Village of Gambier, Ohio.

2. Permit. Prior to installing any private wastewater lift station. the land owner desiring to install such a lift station shall file a written application with the Village Administrator for an installation permit. The application shall be on such form as the Village Administrator may require, and in any event shall include the full name and address of the property owner, the Knox County Auditor's Permanent Parcel Number for the tract or tracts to be benefited bv the lift station; shall briefly detail the location proposed for installation; and shall set forth the reasons the applicant believes a lift station is necessary. The design of the lift station and the specifications for the pump and other components shall comply with the then existing EPA regulations and shall have, at a minimum, a twenty- four (24) hour holding capacity. The Village Administrator shall, within ten(l0)business davs after receipt of a lift station application, approve or deny the application in writing. If the application is disapproved, the Village Administrator shall state specific reasons for disapproval, and the land owner shall have thirty(30)days from the date of such disapproval to appeal the decision to the Mayor.

3. Duties of Owner of Land Benefited by Private Wastewater Lift Station. It shall be the sole responsibility of the owner of land benefited by a private wastewater lift station to pay any and all cost for installation. maintenance, repair. and replacement of a private wastewater lift station.

4. Responsibility to the Health and Safety of the Community. The owner of land benefited by the private lift station shall repair or replace any and all private lift stations that are in need of repair or replacement with in five(5)business days for the health and safety of the community. It is the responsibility of the owner of land benefited by the private lift to notify the Village of Gambier immediately upon discovering the malfunction of the lift station. The Village shall then determine if the water service needs to be terminated until the repair or replacement of the lift station is complete. If the private lift station is not repaired or replaced in the five (5) business days the Village of Gambier will report the violation to the Knox County Health Department. In this case the Village of Gambier reserves the right to hire a certified plumber to repair or replace any lift station that is not attended to in the five(5)business days. The entire cost of the repair or replacement of the lift station shall be the sole responsibility of the owner of land benefited by the private lift station.

5. Effective Date. This Ordinance shall take full effect and be in force at the earliest date allowed by law after passage and approval.

Ordinance 2008-03


AN ORDINANCE TO AMEND INCOME TAX ORDINANCE 1969-09

BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF GAMBIER, OHIO, THAT:

Section 1: Section 6.A is hereby amended to read:

... on or before the last day of the month following the close of each calendar quarter make a return and pay...

Section 2: Section 6.A is hereby amended by adding the following:

Beginning April 1, 2008, employers with withholding of less than five hundred dollars ($500.00) per quarter shall make returns on a quarterly basis, the due dates being the last day of April, July, October and January. Employers with withholding of more than five hundred dollars ($500.00) per quarter must make returns on a monthly basis, the due date being the fifteenth(15th)day of the following month. If an employer has qualified for monthly remittance in any one quarter during the calendar year, the said employer shall maintain that schedule of payment until the end of the calendar year, where said employer can then file a monthly exempt form and return to a quarterly status for payment if it applies. Any other withholding schedule shall have prior approval of or by the Income Tax Administrator in writing.

Section 3: This Ordinance shall take effect and be in force from and after the earliest period allowed by law.

Ordinance 2008-04


AN ORDINANCE TO ESTABLISH CHESTER LANE AS A ONE WAY STREET FROM WIGGIN STREET TO E. BROOKLYN STREET

BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF GAMBIER, OHIO, THAT:

Section 1: The street known as Chester Lane shall be one way traveling North from Wiggin Street to E. Brooklyn Street.

Section 2: The speed limit on Chester Lane shall be reduced to 15 mph and a new school sign shall be installed.

Section 3: There shall be two one way signs installed at the intersection on Chester Lane and Wiggin Street. There shall be a Do Not Enter sign installed at the intersection of Chester Lane and E. Brooklyn Street.

Section 4: This Ordinance shall take effect and be in force from the after the earliest period allowed by law.

Ordinance 2008-05


AN ORDINANCE TO AMEND SECTION 3, OHIO WATER AND WASTEWATER LICENSES, OF ORDINANCE 2006 - 05

WHEREAS, the Council of the Village of Gambier has determined that it is necessary to revise Ordinance 2006-05. Section 3. upon the recommendation of the Village Mayor, now therefore:

BE IT ORDAINED THAT:

SECTION 3. At the appropriate place within Ordinance 2006-05 the following shall be changed to read: An additional amount. over the Base Rate. will be paid to full time employees for the following:
NOTE: this amount is not subject to or connected to the yearly or otherwise percentage increase.

Ohio Water and Wastewater Licenses as Follows:

For the First Ohio Water and Wastewater Licenses the employee shall receive:

$1.00 per hour for passing the state exam in Water Distribution I. Wastewater Collections I. or Wastewater Operator Class I. and $1.00 per hour for receiving an Ohio State license in Water Distribution I. Wastewater Collections I. or Wastewater Operator Class I.

Any State license obtained after the first one, the employee shall receive $1.00 per hour per license.

Any Vi1lage employee obtaining a Water Backflow Certification shall receive $.50 per hour.

Other Responsibilities and Skills:
Maintenance Crew Leader
A one time $1.00 per hour raise at the time of appointment

Maintenance Mechanic
A one time $.50 per hour, starting April 1, 2008

This Ordinance shall take effect and be in force from and after its passage and approval by the Mayor, or at the earlist period allowable by law.

Ordinance 2008-06


AN ORDINANCE TO AMEND ORDINANCE 2007-5, SECTION 1,2, AND 3, AN ORDINANCE SETTING THE WAGES AND BENEFITS FOR HOURLY EMPLOYEES

Whereas, it is necessary to update the Village of Gambier's Wage and Benefit Schedule.

Now Therefore, Be It Ordained: by the Council of the Village of Gambier, Ohio.

SECTION 1 AND 2 SHALL READ:

The current employee rate of participation for the Ohio Public Employees Retirement System will be 10% of wages paid. The Village of Gambier will contribute 6.0% of such fee on behalf of the employee: the balance of any required employee contribution will be paid by said employee. The current Village of Gambier's contribution to the Ohio Public Retirement System will be 14.0% per the Ohio Revised Code.

SECTION 3 SHALL READ:

All Appointed Employees that were actively scheduled and working on January 1, 2008 shall receive a 5% (five percent) increase to the 2008 base rate paid to them.

Other Responsibilities and Skills:

An additional amount, over the Base Rate, will be paid to full time employees for the following:

Webmaster
A one time $.75 per hour raise, starting April 1, 2008

This Ordinance shall take effect and be in force from and after the earliest period allowed by law.

Ordinance 2008-07


AN ORDINANCE AMENDING ORDINANCE 1999-03, TO RE-ZONE ONE BLOCK FROM THE RESIDENTIAL DISTRICT TO MIXED-USE DISTRICT.

WHEREAS, the Council of the Village of Gambier has determined that revisions should be made to Ordinance 1999-03, known as the Gambier Village Zoning Ordinance, upon the recommendation of the Planning and Zoning Commission and after public hearing upon said recommendations as required by law, now therefore:

BE IT ORDAINED THAT

SECTION 1:

The block from the North side of Wiggin Street to the South side of E. Brooklyn Street and from the West side of Acland Street to the east side of Center Run shall be re-zoned from the Residential District to the Mixed-use District.

SECTION 2 REPEALER:

Simultaneously with the passage of the Ordinance, this Ordinance shall amend or repeal any and all Ordinances or sections of Ordinances that shall conflict with the modifications as above stated.

EFFECTIVE DATE:

This Ordinance shall take effect and be in force from and after the earliest period allowed by law.

AN ORDINANCE TO AMEND ORDINANCE 1999-03, CHAPTER 15, SECTION 15.0, RE-ESTABLISHING AND APPOINTMENT OF THE PLANNING & ZONING COMMISSION

WHEREAS, the Village of Gambler has determined that it is necessary to revise Ordinance 1999-03, Chapter 15, Section 15.0. upon the recommendation of the Village Mayor and the Planning and Zoning Commission. now therefore:

BE IT ORDAINED THAT

SECTION 15.0:

At the appropriate place within Ordinance 1999-03 the following shall be changed to read:

...The Planning Commission shall consist of the Mayor, a Council member, and five (5) citizens of the Village of Gambier. appointed by the Mayor and approved by Council, to serve six (6) year terms...

This Ordinance shall take effect and be in force from and after the earliest period allowed by law.

Ordinance 2008-09


AN ORDINANCE TO AMEND 2008-05 AND 2006-05, SECTION 3, OTHER RESPONSIBILITIES AND SKILLS

WHEREAS, the Council of the Village of Gambier has determined that it is necessary to revise Ordinance 2008-05 and 2006-05. Section 3, upon the recommendation of the Village Mayor, now therefore;

BE IT ORDAINED THAT

SECTION 3:

At the appropriate place within Ordinance 2008-05 the following shall be changed to read:

Maintenance Crew Leader $1.00 per hour
Maintenance Mechanic $.50 per hour
Webmaster $.75 per hour

The per hour rate will be retroactive to April lst, 2008.

At the appropriate place within Ordinance 2006-O5 the following shall be omitted:

... Additionally, all hourly employees will receive a one time only $1.00 per hour raise for dedication and stellar work performed in the reduction of expenses to the Village of Gambier's operating budget...

This Ordinance shall take effect and be in force from and after the earliest period allowed by law.
