ORDINANCE 2017-11

AN ORDINANCE ESTABLISHING RATES, CHARGES AND RULES FOR THE USE AND SERVICE OF THE MUNICIPAL WATER SYSTEM OF THE VILLAGE OF GAMBIER, KNOX COUNTY, OHIO

WHEREAS, the Council of the Village of Gambier has determined that it is necessary to increase the Revenue of the Municipal Water System, and

NOW, THERFORE; be it ordained by the Council of the Village of Gambier, Knox County, Ohio as follows:

SECTION 1:

That there shall be and there is hereby established for the use of and services rendered by the waterworks system of the Village of Gambier the following rates and charges, based on the use of water supplied by the waterworks system:

A. METERED CHARGES

Effective with the billing period starting on or about May 15, 2017 the rate shall be $12.38 (twelve dollars and thirty-eight cents) per 1,000 gallons of water.
Effective December 1, 2017 the Village of Gambier will start billing monthly for water and sewer.

B. MINIMUM CHARGES

Each user shall pay a minimum charge based on the size of the meter installed for which the user will be entitled to the quantity of water set in the metered schedule of rates:

5/8” or ¾” meter – 1,000 gallons
1” to 1 ½” meter – 2,000 gallons
2” and larger meter – 7,000 gallons

Effective with the billing period starting on December 1, 2017:
Per month per inch meter size:

5/8 or ¾ inch meter – $12.38 (twelve dollars and thirty-eight cents)
1 to 1 ½ inch meter – $24.76 (twenty-four dollars and seventy-six cents)
2 and larger meter – $86.66 (eighty-six dollars and sixty-six cents)

C. CAPACITY CHARGES

Each user, at the time of application for connection to the water system, shall pay a connection charge plus any additional costs for labor and materials if an existing tap is not available.

Capacity charges based upon water tap sizes and sewer tap sizes are as follows:

Time frame for payments for capacity charges.

Any person or corporation can make arrangements to pay the capacity charges over a three year period with no penalty.

After the three year period, the person or corporation will be assessed a 10% penalty per month for the outstanding balance.

The payment arrangement is available for any and all users regardless of tap size and location.

D. DEPOSIT REQUIRED

The Village reserves the right to require a nominal sum be placed on deposit with the municipality for purposes of establishing or maintaining customer credit.

E. RECONNECTION CHARGES

Any customer whose service has been disconnected for reason of non-payment of quarterly or other charges, or violation of any other water rule or regulation, and such service is subsequently restored, shall pay a reconnection charge of $35.00 (thirty-five dollars).

F. TEMPORARY USERS

Water furnished to temporary users, such as construction contractor, shall be charged on the basis of metered Rates used multiplied by the applicable rate from Section 1A of this Ordinance. A minimum Deposit of $50.00 (fifty dollars) will be required for all temporary users. Any contractor working in the Village of Gambier needing to use water from a fire hydrant shall contact the Village Offices and tell the Village the location of the construction and when the water is needed. The Village of Gambier will attach a meter and backflow device on the closest fire hydrant to the construction and take a reading from the meter. Once the contractor is finished using water they shall contact the Village office to have the meter removed. A reading will be taken from the meter before it is removed and a bill will be issued for the water used.

G. CONNECTION OUTSIDE THE MUNICIPAL CORPORATION LIMITS

Charges for any water service outside the corporation limits of the Village of Gambier will be billed at the rate of 140% (one hundred and forty percent) of the rated as specified in Section 1A and Section 1B of this Ordinance. Other rates shall remain the same specified in the applicable section.

SECTION 2:

Bills for the rates and charges as herein established by the Municipality shall be sent monthly. All bills shall be mailed as soon after meter reading as possible and shall be immediately payable and shall be paid at the Village offices or the People’s Bank of Gambier or you may set up electronic payment with the Village of Gambier Office. If any charges for service of the system shall not be paid by the 5th day of the month following the rendition or mailing of the bill, and the bill has become due and payable, a delayed and or late payment charge of 10% (ten percent) of the amount of the bill shall be added thereof and collected therewith. If any bill for the service of the water system shall remain unpaid after 14 (fourteen) days following the due date therefore; the water supply to the lot, parcel of land or premise affected may be turned off and will not be turned on again except after payment-in-full of the delinquent charges plus an additional payment of $35.00 (thirty-five dollars) per Section 1E of this Ordinance. The Village of Gambier will work to complete the installation of the radio reading system for all meters in the Village of Gambier. The Village of Gambier is providing the cost for the first radio meter reader installed. If the radio reader is damaged by the property owner or someone working on the property for the owner, the property owner is responsible for the cost to replace the radio reader. The replacement cost is $200.00 paid to the Village of Gambier.
An invoice will be sent to all property owners regarding a damaged radio reader. If the replacement cost is not received by the due date the water service to the property will be turned off until payment is received.

SECTION 3:

Application for water service shall be filed with the Village Administrator upon a form to be supplied by the Municipality. The application shall state the name of the applicant and the premises to be served. All applications shall be accompanied by the connection charge plus a fee to be determined by the Village Administrator, based on estimated installation costs, payable to the Water and wastewater Department of the Village of Gambier, Ohio as a deposit for the connection charges. Upon completion of the service connection the full connection charge will be certified to the applicant in accordance with the charges specified in Section 1C of this Ordinance. Full payment of the connection charge must be received before service to the lot, parcel or premise in commenced.

SECTION 4:

The owner of the premises served and the occupant thereof and the user of the water service shall be jointly and severally liable for the water service provided said premises. A deposit may be required from tenants. Such deposit shall be applied to any bill for water service delinquent more than 10 (ten) days. Upon the disconnection of the water service, any balance of such deposit shall be returned to the applicant without interest. Any and all charges of water service, not paid on the date due, constitutes a lien on the lot, parcel or premises served and shall be certified to the Knox County Auditor for collection if such charges remain delinquent for a period of 80 (eighty) days.

SECTION 5:

It is hereby made the duty of the Clerk of the Water and Wastewater Department to render bills for water service and all other charges in connection therewith and to collect all moneys due therefrom.

SECTION 6:

All revenues and moneys derived from the operation of the water system shall be paid to and held by the Village of Gambier separate and apart from all other funds of the Municipality and all of said sums and all other funds and moneys incident to the operation of said system, as may be delivered to the Village of Gambier shall be deposited in a separate fund designated the “Water Revenue Fund” and shall be administered in every respect in manner provided by the Code of the State of Ohio and all laws pertaining thereto.

SECTION 7:

The Clerk shall establish a proper system of accounts and shall keep proper records, books and accounts in which complete and correct entries shall be made of all transactions relative to the water system and the regular intervals the Village Council shall cause to be made a audit as required by the Revised Code of the State of Ohio.

SECTION 8:

All Ordinances and parts of Ordinances in conflict herewith are hereby repealed insofar as the conflicting portion thereof are concerned.

SECTION 9:

This Ordinance is hereby declared a preservation of the public peace, health, safety and welfare of the Village residents; wherefore this Ordinance shall be in full force and effect from and immediately after its passage.
